CONDITIONS FOR USE OF THE

“AMENDMENT ONE” COLUMN

 A.           DON SCHELLHARDT agrees to write at least one article per month for the Internet and/or print media column entitled AMENDMENT ONE.    This agreement is subject to cancellation and/or modification by Don

Schellhardt after thirty (30) days’ notice. 

B.           DON SCHELLHARDT, while willing to gratefully accept donations of any amount for the services he provides, nevertheless further agrees that he will charge no fee(s) for the Internet posting of, and/or the printing of, any article drawn from this column    --   except, as referenced in Section

C (i), in the case of a party who posts and/or prints one or more articles,

         drawn from this column, for purposes of making, or attempting to make,

         a profit.    This further agreement is subject to cancellation and/or

         modification by Don Schellhardt after thirty (30) days’ notice. 

C.        In return, any party who posts and/or publishes one or more of the

         articles written for this column (hereafter referred to as “THE

         CONTRACTING PARTY”) agrees to the following conditions: 

(i)                  The column in question shall be posted only on the contracting

 party’s Web Site, and/or shall be printed only in the contracting

 party’s publication, unless Don Schellhardt expressly authorizes

 re-posting or re-publication elsewhere.    That is:    The

 contracting party agrees not to authorize, or in any manner

 facilitate, re-production of any material from the column by any

 other party, and/or in any other context, unless Don Schellhardt

  has been informed of such intended re-production and has

  expressly authorized such re-production in advance. 

(ii)                As a related condition, the contracting party agrees that the

words COPYRIGHT 2003 BY DON SCHELLHARDT shall

always appear on the bottom of each AMENDMENT ONE article that is posted and/or printed by the contracting party. 

(iii)              The contracting party agrees that it will never post and/or print

an article drawn from the AMENDMENT ONE column for thepurpose of making, or attempting to make, a profit   --   unless the contracting party has first arranged to provide a mutually agreeable form and amount of compensation to Don Schellhardt.
